1. INTRODUCTION

WasteWiseAI Inc. ("Company," "we," "our," or "us") respects your privacy and is committed to protecting it through our compliance with this Privacy Policy ("Policy"). This Policy describes the types of information we may collect from you or that you may provide when you use our restaurant management software platform, website, mobile applications, and related services (collectively, the "Service") and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Policy applies to information we collect:

  • Through our Service

  • In email, text, and other electronic messages between you and our Service

  • Through mobile and desktop applications you download from our Service

  • When you interact with our advertising and applications on third-party websites and services

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Service. By accessing or using our Service, you agree to this Policy.

2. INFORMATION WE COLLECT

We collect several types of information from and about users of our Service, including:

2.1 Personal Information:

  • Contact Information: Name, email address, mailing address, phone number, and other contact details

  • Account Information: Username, password, account settings, and preferences

  • Business Information: Restaurant name, type, location, business hours, and other business-specific details

  • Payment Information: Credit card numbers, billing addresses, and other payment details (note: payment processing is handled by secure third-party payment processors)

  • Staff Information: Staff names, contact information, positions, pay rates, and schedules that you input into the system

2.2 Content Information:

  • Inventory Data: Food inventory, cleaning products, paper products, and other supplies

  • Recipe Information: Ingredients, measurements, processes, yields, and cook sheets

  • Purchase Data: Vendor information, purchase history, and pricing

  • Menu Information: Menu items, pricing, and descriptions

2.3 Voice Data:

  • Voice Recordings: Audio recordings when you use our voice command interface

  • Voice-to-Text Conversions: Text derived from processing your voice commands

2.4 Usage Data:

  • Log Data: IP address, browser type, operating system, referring website, pages visited, time and date of visit, time spent on pages, and other statistics

  • Device Information: Device type, operating system, unique device identifiers, and mobile network information

  • Location Data: General location derived from IP address

2.5 Cookies and Similar Technologies:

  • Cookies: Small data files stored on your device

  • Pixels: Small graphic images that allow us and third parties to monitor the use of the Service

  • Local Storage: Information stored locally on your device for use by our Service

5.2 To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them, including:

  • Cloud hosting providers

  • Payment processors

  • Analytics providers

  • Customer service providers

  • Voice processing technology providers

5.3 To vendors and suppliers through our procurement/purchasing program, but only to the extent necessary to facilitate transactions you initiate.

5.4 To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets.

5.5 For legal purposes:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request

  • To enforce our Terms of Use and other agreements

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our Company, our customers, or others

5.6 With your consent or direction to do so.

5.7 In aggregated or de-identified form that cannot reasonably be used to identify you.

6. DATA RETENTION

We retain your personal information for as long as necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required or permitted by law. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

When we no longer need to use your information, we will take reasonable steps to remove it from our systems and records or take steps to anonymize it so that it no longer identifies you. Upon any termination, Company will make all Customer Data available to Customer for electronic retrieval for a period of thirty (30) days, but thereafter Company may, but is not obligated to, delete stored Customer Data. 

7. DATA SECURITY

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on secure servers behind firewalls. Any payment transactions will be encrypted using industry-standard SSL technology.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Service. Any transmission of personal information is at your own risk.

8. YOUR CHOICES ABOUT YOUR INFORMATION

8.2 Communications Preferences. You may opt out of receiving marketing emails from us by following the unsubscribe link or instructions provided in each email. You cannot opt out of receiving administrative messages related to your account or the Service.

8.3 Cookies and Tracking Technologies. Most web browsers are set to accept cookies by default. You can usually choose to set your browser to remove or reject browser cookies. Please note that removing or rejecting cookies could affect the availability and functionality of our Service.

8.4 Voice Data. You can choose not to use the voice command interface and instead use the traditional interface of our Service. Voice data is only collected when you actively use the voice command feature.

9. CHILDREN'S PRIVACY

Our Service is not intended for children under 18 years of age. We do not knowingly collect personal information from children under 18. If you are a parent or guardian and believe we may have collected information about a child, please contact us at support@wastewiseai.com.

10. CALIFORNIA PRIVACY RIGHTS

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information. 

Under California Civil Code Section 1798.83, California residents may request information regarding the disclosure of their personal information to third parties for direct marketing purposes. To make such a request, please contact us at support@wastewiseai.com.

11. DO NOT TRACK SIGNALS

Some web browsers may transmit "do-not-track" signals to the websites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.

12. INTERNATIONAL DATA TRANSFERS

Our Service is primarily intended for users located in the United States. If you are accessing our Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located. By using our Service, you consent to the transfer, storage, and processing of your information in the United States.

13. CHANGES TO OUR PRIVACY POLICY

We may update our Privacy Policy from time to time. If we make material changes to how we treat our users' personal information, we will post the new Privacy Policy on this page with a notice that the Privacy Policy has been updated and change the "Last Updated" date at the top of this Policy. You are responsible for periodically visiting our Service and this Policy to check for any changes.

14. DATA PROCESSING AGREEMENTS

If you are a business subject to the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), or similar laws, and you use our Service to process personal information of your customers or employees, we will enter into an appropriate data processing agreement with you. 14.1 Data Protection Officer (DPO)

WasteWiseAI has appointed a Data Protection Officer (DPO) to oversee GDPR compliance and serve as the primary contact for data protection authorities and individuals.

14.3 Data Subject Rights

Individuals in the EEA/UK have the right to:

Access: Obtain confirmation of whether their data is processed and a copy of such data [§8.1]

Rectification: Correct inaccurate or incomplete personal data [§8.1]

Erasure: Request deletion of data where no overriding legal basis exists [§8.1]

14.4 Cross-Border Data Safeguards

For transfers of EEA/UK personal data to third countries (e.g., the U.S.), WasteWiseAI ensures compliance via:

EU Standard Contractual Clauses (SCCs):

  • Module 2 (Controller-to-Processor): Applied when WasteWiseAI acts as a processor for EU/UK customers [§5.2, §14]

  • Module 1 (Controller-to-Controller): Applied for transfers to vendors/sub-processors [§5.3]

  • SCCs include mandatory clauses for technical/organizational safeguards (e.g., encryption, access controls) [§7]

Supplementary Measures: Where required by Schrems II, additional protections (e.g., data pseudonymization, third-country legal assessments) are implemented.

Data Localization: Customer data is stored in [AWS US-East Region], with EU/UK data processed only via SCCs and GDPR-aligned sub-processors.

15. SPECIFIC PRIVACY CONSIDERATIONS FOR KEY FEATURES

15.1 Inventory Management with Voice-to-Text: 

  • Voice recordings are processed to convert speech to text

  • Voice data may be stored temporarily to improve voice recognition algorithms 

  • Text conversions are stored in your account to maintain your inventory database

15.2 Recipe/Menu Management:

  • Recipe and menu data is stored in your account

  • This information is not shared with third parties except as described in this Policy

15.3 Procurement/Purchasing Program:

  • Vendor APIs may receive information about your purchasing needs

  • Transaction data is stored to maintain your purchase history

  • Pricing information may be shared between vendors and your account

16. Notice at Collection

WasteWiseAI collects personal information such as names, contact details, business information, payment data, and voice recordings for the purposes of providing and improving our services, processing transactions, and supporting customer accounts. We may share this information with service providers and vendors as described in our Privacy Policy. We do not sell your personal information. You have the right to access, delete, correct, and limit the use of your personal information, as well as opt out of the sharing of your information for certain purposes.
